All services advertised on this website are offered in compliance with Australian Consumer Law.

As a naturopath service, provided consultations include thorough questioning, examinations such as iridology and tongue & nail diagnosis, and treatment plans. Treatment plans include liquid herbs, herbal infusions/teas, herbal creams and supplements, nutritional supplements, as well as dietary advice + meal planning, to lifestyle recommendations. Our intention is to support you while creating the right environment for the body, mind and spirit to come back to homeostasis.

Our Responsibility

Zaerën Safi-Momand of Empyreal Clinic® is a qualified Naturopath, with a Bachelor in Health Science in Naturopathy and a member of Australian Natural Therapists Association (ANTA). This qualification allows the practitioner the ability to provide naturopathic services and dispense practitioner-only products.

Your Responsibility

During a consultation, we need to find out as much as we can about you, your current health and your health history to make the safest and most effective treatment plan for you. To get a holistic overview, a lot of questions about things such as symptoms, illnesses, body systems and processes, mental health, current living situation and family history will be asked.

You must disclose all medications and other natural medicines you are taking. We need to know if you are using the oral contraceptive pill or other hormonal or nonhormonal forms of birth control, including IUDs. We need to know if you stop, start or make changes to any pharmaceutical medications, herbal medicines or supplements during treatment. We need to know if you are taking or have previously taken any drugs - pharmaceutical, recreational, legal or illegal. This information is important so we can understand and mitigate any potential interactions with the natural treatments we introduce.

We need to know about any allergies you have. We need to know if you have any current medical issues or past medical issues. We need to know if you are pregnant, trying to become pregnant or are breastfeeding. We need to be informed if your situation or health status changes during the course of treatment or if anything else changes since the last consult.

You need to notify immediately if you experience any worsening symptoms or any unpleasant or unwanted side effects or reactions after commencing each new or recurring herbal medicine liquid, supplement or other treatment. Reactions may indicate a sensitivity or allergy to a herb so it is your responsibility to notify immediately so we can rectify or cease that particular treatment.

We assume that the answers and information you provide are true and accurate. If for whatever reason you have not provided accurate information, contact your practitioner.

It is important you do not take any other supplements during the course of the treatment.

Caution

Herbal and natural remedies can be dangerous if used incorrectly. Herbs, vitamins and minerals have a safe and therapeutic dosage range which needs to be adhered to. Use natural remedies only as instructed to ensure your safety.

Important Information

We do not guarantee results or improvements in any condition or symptom. Should you commence treatment with us, you agree to take any natural treatments, dietary advice, herbal medicine and nutritional supplements at your own risk. Everyone responds differently to natural medicines and there may be a chance you do not see any benefit or symptoms become worse. We are not held responsible in the situation should your health condition or symptoms become worse after commencing natural treatment under our care. If symptoms do worsen, contact your practitioner to discuss and they can refer you on if required.

Payment Terms

Forms of Payment

Credit/debit card details are to be provided to book an appointment. After the consult, banking details will be provided for payment of additional costs for supplements, etc, if choosing to embark on the protocol. Payment will need to be made first before supplements are sent.

Shipping and Delivery

When your practitioner prescribes products from the clinic dispensary during a consultation, a postage will be arranged via Australia Post. Two options are available: Pick-up & Delivery. Booking for delivery of a herbal or individualized nutritional compounded formula will not mean the item will arrive on that booked day. It means the practitioner will deliver your prescription on the day. Must pay the prescription invoice before booking a refill. Cancellations or non-attendance in picking up the item will not initiate a refund for the compounded supplement. If you have cancelled a pick-up, refer to email appointment notification or contact the practitioner for a reschedule. Payment from the cancelled pick-up time will compensate the rescheduled time. If due to non-attendance, this will not initiate a refund and you will need to book another consult block for pick-up. The practitioner puts their time and effort to organize your compounded supplements.

Consultations

Consults are held face-to-face and thru online Telehealth. For face-to-face, you will be sent the clinic address to your email. For online, you will be sent a Google video chat link before your consult begins. We operate locally, nationally and internationally from Boorloo, Aboriginal Land.

Counselling

We follow strict ethical guidelines as outlined by the Australian Counselling Association. This means we will not disclose the information gathered during consultations, counselling or assessments to any external party without your written consent. The only circumstance in which we would be required to disclose confidential information is where there is a legal obligation to do so, or if there is a significant risk of harm to another person. We respected your privacy and comply with the National Privacy Principles identified in the Privacy Amendment (Private Sector) Act 2000. The information collected will be used to assist us in providing you with appropriate support. Please be assured that we will not, at any time, disclose your name or personal details to any outside agency or individual.

Cancellation Policy

Cancellations or non-attendance on the day of the consult will not initiate a refund. Refer to emailed appointment notification or contact the practitioner for a reschedule. Payment from the initially booked appointment will compensate the rescheduled time. You will not be able to secure the reschedule compensation 24 hours before the scheduled appointment. See Returns Policy below.

Returns Policy

We do not offer a refund for change of mind for any services or products, this includes consults and remedies such as herbal tinctures, teas, herbal creams, herbal or nutritional supplements. See Cancellation Policy above.

Naturopathic Script

The scripts provided are exclusive to the Empyreal Clinic and will prevent any confusions that can occur in dispensing through other establishments, including other pharmacies.

Express Compounding

This service is for patients who are needing top ups for their herbal and nutritional compounded prescriptions. The cost of the prescription is separate from the service time to compound and/or organize delivery.

For branded supplements you will not need to book the Express Compounding service. All you need to do is pay for the invoice and your practitioner will organize the delivery with the supplier

Consumer Guarantees

You may receive products via postal delivery. If there is any damage to your products in transit, notify immediately and send photographic evidence of the damage. A replacement will be arranged for you as soon as possible at no extra cost to you.

Herbal tinctures are stored in glass bottles which are fragile. If you accidentally drop or break the bottle, you can order a replacement at full price plus shipping.

If your practitioner is unable to attend your scheduled consult for any reason, your practitioner will do their best to give as much notice as possible and reschedule your appointment to a mutually beneficial time. If the reason is due to your practitioner falling ill and the illness continues for a considerable time, the consult will be placed on hold for the time being until your practitioner is fit to reschedule.

If the internet cuts out during an online consultation, your practitioner will continue the consultation via phone call.

If a digital download or link doesn’t work or a PDF doesn’t open, contact your practitioner.

If an allergic reaction occurs due to taking a natural medicine prescribed, cease taking immediately and seek medical advice if needed. Contact your practitioner to organise an alternative remedy for you.

In the rare occurrence that a herbal medicine liquid, product or nutritional supplement is recalled and deemed unsafe, your practitioner will contact you immediately to cease the consumption of the specific product. If you find a herbal medicine or supplement is faulty or suspected to be unsafe, contact your practitioner immediately to discuss and to organise a replacement if needed.

Digital Tools & Technology

We use the Heidi Health AI app during consultations to assist with secure, accurate, and efficient note-taking, ensuring comprehensive documentation of your care. This tool is used only with your explicit consent and complies with all privacy and security regulations. For any questions or concerns, feel free to discuss them with your practitioner.

Jurisdiction & Dispute Resolution

Jurisdiction

Zaerën Safi-Momand of Empyreal Clinic® is currently located in Western Australia. This agreement is subject to the governing law of Western Australia.

Negotiation

If you have any issue or complaint arising out of your use of this website or these terms and conditions, we both agree to make a genuine effort to resolve the dispute through negotiation and discussion.

Mediation

If we are unable to resolve a dispute by negotiation and discussion within 14 days, we agree to proceed to mediation with the assistance of an independent accredited mediator, seeking online dispute resolution or mediation by telephone if we are not both in the same location. The mediator is to be appointed by agreement between us or, failing agreement within twenty-one (21) days of the first notification of the dispute, the person initiating the dispute will seek the appointment of a dispute resolution professional by the Resolution Institute here. The Resolution Institute Mediation Rules shall apply to the mediation. We agree to share the costs of mediation equally between us.

Litigation

It is a condition precedent to the right of either party to commence litigation other than for interlocutory relief that it has first offered to submit the dispute to mediation. Litigation is to be considered a last resort and may not be commenced until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.

Privacy Policy

Empyreal Clinic® recognises and follows the requirements of the Commonwealth Privacy Act 1988 and the Australian Privacy Principles. The Privacy and Confidentiality Policy ensures security and safety of all personal details of clients in clinic, and online. Breaches of Privacy will not be accepted by this business. Client information and data will be not be shared, discussed or acknowledged outside of consultations, and all online information will be protected. Information is only to be accessed by your practitioner.
